Terms of use
These terms govern this website, the online booking and intake tools, and the AI assistant that answers the telephone. They do not govern your treatment. Nothing here limits the responsibility Peter K. Cudjoe carries as the treating surgeon, and nothing here asks you to give up a right you have as a patient.
1 · What these terms cover
This site is operated by The Wisdom Tooth Clinic (The Wisdom Tooth Clinic for Teens and Adults, PC), 2960 Aventura Blvd, Suite 306, Miami, FL 33180. Using the site, the booking tools or the telephone assistant means you accept these terms. If you do not accept them, do not use those tools — you can reach the practice by telephone instead.
These terms are about software and information. Your care is governed by the consent you sign, by the professional obligations of the treating surgeon, and by Florida law. Where those conflict with anything below, those prevail.
2 · This website is not clinical advice
Everything published here is general information about oral and maxillofacial surgery. It describes what is typical. It cannot account for your medical history, your radiographs, or the position of your teeth, and it is not a diagnosis.
Reading this site does not create a doctor–patient relationship. That relationship begins at a consultation, after an examination and imaging, and not before. Submitting a booking request or speaking to the assistant does not begin it either.
Do not delay seeking care, or disregard advice you have been given, because of something you read here.
3 · Emergencies
This site is not monitored for emergencies
The telephone assistant is not an emergency service. It is available outside office hours, but it cannot triage a medical emergency and it will tell you so.
4 · The AI assistant
The practice uses an AI assistant to answer the telephone, take bookings and collect intake. These are the terms specific to it.
You are told, every time
You are told that you are speaking with an automated assistant and that the call is recorded, at the start of every call and before any speech recognition begins. The disclosure is repeated at the end. Florida is an all-party consent state under Fla. Stat. §934.03, and consent is captured and logged with a timestamp.
If you would rather not be recorded, say so and you will be routed to a path that is not recorded. You are not required to use the assistant to become a patient.
What it does, and does not, do
The assistant schedules appointments, checks insurance eligibility, collects intake answers and answers questions about the practice. It does not diagnose, it does not recommend treatment, and it does not decide anything clinical. Every safety-relevant decision in the system — clinical red flags in intake, emergency classification, whether a patient is a minor — is made by rule-based code that the assistant cannot override, and is surfaced to the surgeon regardless of what the assistant says.
The assistant does not state a price, a coverage amount or an appointment time that did not come from a live system response in the same conversation. Where it cannot confirm something it says so and offers a callback rather than guessing.
It can still be wrong
Automated systems make mistakes. A time can be misheard, a name can be mis-transcribed, an eligibility response can be stale or wrong at the payer’s end. Confirmations are sent in writing, and you should read them. If a written confirmation does not match what you understood, the written confirmation is not automatically right either — call the practice and it will be sorted by a person.
You can ask for a person at any point in any conversation with the assistant.
5 · Coverage checks and estimates
The coverage checker returns an estimate. It is built from what your insurer reports at that moment about your plan, your deductible and your benefits, and from what the surgeon expects the procedure to involve before he has examined you.
An estimate is not a quotation and it is not a promise of coverage. The amount you owe is determined by your insurer after the claim is adjudicated, by what is actually done on the day, and by the terms of your own plan. Findings change during surgery. Insurers reprocess claims. Both are ordinary and both can move the number.
You are responsible for the accuracy of what you tell us — your plan details, your medical history and your medication list. An estimate built on incorrect information will be incorrect, and a medical history that omits something matters far more than the estimate does.
6 · Acceptable use
Do not use this site or these tools to:
- Book appointments you do not intend to attend, or make repeated bookings under different identities.
- Submit another person’s information without their authority, or impersonate anyone.
- Attempt to access accounts, records or systems that are not yours, or probe the site for vulnerabilities without written permission.
- Scrape, crawl or copy the content of this site at scale, or reuse it commercially without permission.
- Send anything unlawful, threatening or deliberately false through any form or to the assistant.
Access may be withdrawn where these are breached. That does not affect your right to treatment or to your own records.
7 · Content and intellectual property
The written content, layout and design of this site belong to The Wisdom Tooth Clinic (The Wisdom Tooth Clinic for Teens and Adults, PC) or to its licensors. You may read it, print it and share a link to it. You may not republish it as your own, and you may not present it as clinical guidance issued to a patient you are treating.
The clinical articles are written or reviewed by Peter K. Cudjoe and carry the date of review. Where a page is still in draft it says so on the page and carries no review by-line.
8 · Disclaimer — website and software
The website and the software are provided on an “as is” and “as available” basis. To the fullest extent Florida law permits, The Wisdom Tooth Clinic (The Wisdom Tooth Clinic for Teens and Adults, PC) disclaims implied warranties of merchantability, fitness for a particular purpose and non-infringement in respect of the website and the software.
We do not warrant that the site will be uninterrupted, that the booking system will be available at any given moment, that an estimate will match a final bill, or that information published here is complete or current at the moment you read it.
This disclaimer applies to software and information. It does not apply to clinical care, and it does not disclaim any duty owed to you as a patient.
9 · Limitation of liability
This clause is deliberately narrow. The parts of it that would not be enforceable are left out on purpose.
To the fullest extent Florida law permits, The Wisdom Tooth Clinic (The Wisdom Tooth Clinic for Teens and Adults, PC) is not liable for indirect, incidental or consequential loss arising from the website or the software — for example a missed appointment caused by a booking system outage, or an estimate that differs from a final bill.
Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded. That expressly includes:
- Liability for personal injury or death caused by negligence in the provision of care.
- Any obligation under HIPAA, 45 CFR Parts 160 and 164, including your rights of access, amendment, accounting and complaint.
- Any obligation under Fla. Stat. Chapter 466 or the rules of the Florida Board of Dentistry.
- Any obligation under the Florida Deceptive and Unfair Trade Practices Act.
- Fraud or fraudulent misrepresentation.
Accepting these terms does not waive any right you have as a patient, and does not release the practice or the surgeon from responsibility for your treatment.
10 · Governing law and disputes
These terms are governed by the law of the State of Florida. Proceedings relating to the website or the software are brought in the state or federal courts serving Miami-Dade County, Florida.
If you are unhappy with something, the practice would rather hear it directly and first. Contact details are below. A complaint about privacy can also go to the practice’s privacy officer, or to the U.S. Department of Health and Human Services Office for Civil Rights — see the privacy policy. You will not be penalised in any way for making one.
11 · Changes, and how to reach us
These terms may change. The version published here is the one in force, and the revision date is shown below. Material changes to how information is handled are described in the privacy policy and, where HIPAA requires it, in the Notice of Privacy Practices.
